Nudity

Our app permits the sharing of certain types of nudity, specifically breasts and buttocks when presented in artistic, educational, or similarly value-driven contexts. However, we strictly prohibit the sharing of genital nudity (any part of the vulva/labia or penis/testicles), explicit sexual acts, and pornographic content.

For images containing nudity of individuals other than yourself (models, for example), you must have obtained explicit consent from the individual in the form of a signed model release. This ensures respect for individuals' rights to privacy and control over their image. We may request proof of this release anytime if a question arises about your shared content. Failure to provide proof of consent, we reserve the right to remove the content in question and take appropriate action, including account suspension or termination.

For content featuring minors, we allow family-friendly and non-sexual content, such as images of children at the beach or pool, for example. However, images of bare-chested children or children in swimwear should only be shared within appropriate and non-exploitative contexts. Content featuring minors in sexual, suggestive, or exploitative contexts is strictly prohibited. Sharing such content will result in immediate account termination, and if applicable, we will report such content to the relevant authorities.

Sex solicitation of any kind is not permitted on our platform. Violations will lead to immediate action, including account termination and reporting to law enforcement.

We reserve the right to remove any content deemed inappropriate and maintain a zero-tolerance policy regarding the sexualization of minors and sex solicitation.


Violence

Our app prohibits content that gratuitously promotes or glorifies violence. However, graphic content may sometimes be necessary to convey news events or for educational purposes. In such cases, graphic content must include clear warnings and contextual explanations.

Content shared for news or educational purposes should never celebrate or glorify violence. Instead, it should aim to inform, educate, or raise awareness about specific issues. For example, content depicting war scenes, protests, or historical events may be shared as long as the intent is to inform and educate rather than promote violence.

We reserve the right to review and remove any content that violates these guidelines. Users who repeatedly violate this policy may face penalties, including account suspension or termination. A progressive penalty system may apply, starting with warnings for first-time violations.

Please remember that depicting violence may not be suitable for all audiences and may be subject to additional restrictions or limitations.

Hate Speech and Harassment

Our app has a zero-tolerance policy for hate speech of any kind. Hate speech includes any content, such as abusive comments, stalking, or threatening behavior in any form that demeans, degrades, harasses, or threatens individuals or groups based on attributes such as race, religion, ethnic origin, sexual orientation, disability, or gender. Such content will be removed to foster a welcoming and respectful community, and the accounts involved may be terminated.

Misinformation

We strongly discourage the spread of misinformation. Deliberately posting false information or engaging in deceptive practices, such as phishing, impersonation, or scams to mislead or harm others or the community, is strictly prohibited. Violations may result in content removal, account suspension, and, where applicable, reporting to authorities. We encourage all users to share information responsibly and verify the authenticity of their content before posting.

Spam and Bot Accounts

We strive to maintain an authentic and engaging community by prohibiting behaviors that undermine the integrity of our platform. This includes spamming and the use of bot accounts.

Spam includes unsolicited, repetitive messages, comments, or content shared on our platform. Users must not manipulate our platform to increase views, likes, or comments and should not post repetitive content or comments.

Bot accounts, or automated accounts controlled by software rather than humans, are strictly forbidden. This includes accounts designed for mass-following, mass-commenting, or manipulating our community.

Users found to be engaging in spamming or operating bot accounts may face consequences ranging from content removal to account suspension or termination, depending upon the severity of the violation.

This policy exists to ensure a high-quality user experience, and we reserve the right to enforce it at our sole discretion.

Original Content

Users are expected to post original content that they have created themselves. Posting copyrighted or trademarked material without the explicit permission of the rights holder is prohibited. Violations of this rule will result in the removal of the content and could lead to account suspension or termination. Repeat violations may also result in legal actions if requested by the rights holder.

Foto Curation Account Policy

Foto encourages educational and community-driven curation while respecting the rights of artists. Curation accounts must adhere to the following guidelines:

1. Educational & Commentary Use is Allowed

• Curation accounts that focus on education, artistic discussion, historical context, or technique analysis are permitted.

• Simply reposting others’ work without meaningful commentary is discouraged.

2. Mandatory Artist Credit

• The original artist must be credited within the first three lines of the caption.

• If the artist has a Foto account, they must be tagged in the post.

• If the artist requests a different form of credit, curators should respect their wishes.

3. Takedown Requests Will Be Honored

• If an artist requests the removal of their work, Foto will comply within a reasonable timeframe.

• Artists do not need to provide a reason; their request alone is sufficient.

4. No Use of Others’ Work for Commercial Promotion

  • Curation accounts may not use another artist’s work to promote their own business, services, or events (e.g., workshops, courses, prints, paid memberships, or sponsorships) without the artist’s written permission.

  • Written permission must be available upon request and must clearly state that the artist has granted permission for their work to be used in the specified manner.

  • If an account fails to provide written permission upon request, it will be permanently banned from Foto.

5. Repeat Infringement Policy (Strike System)

1st & 2nd violations → Warning issued.

3rd violation → 7-day account suspension.

4th violation → 30-day account suspension.

5th violation → Permanent ban.

Curators may appeal strikes if they can demonstrate they had permission or made a good-faith effort to follow Foto’s policy.

6. Foto’s Role in Enforcing These Rules

• Foto does not actively monitor content but will respond to artist complaints.

• Accounts that repeatedly fail to comply risk content removal, restrictions, or bans.


Impersonation Policy

At Foto, we celebrate authenticity and the power of real photography. To maintain a safe and trustworthy platform, we do not allow the impersonation of individuals, brands, or organizations.

What Counts as Impersonation?

An account is considered impersonation if it:

• Pretends to be another person, brand, or organization without their permission.

• Uses someone else’s name, logo, or likeness in a way that is misleading or deceptive.

• Uploads copyrighted content, such as marketing materials, media, or official branding, without authorization.

• Intends to trick, mislead, or confuse other users about its true identity.

What’s Allowed?

Fan accounts: If you want to create a fan account, it must clearly state that it is unofficial and not affiliated with the entity being referenced.

Parody or satire accounts: These must be clearly labeled as parody and should not be misleading.

What Happens If You Violate This Policy?

If we determine that an account is impersonating someone else:

1. We will remove or restrict the account immediately.

2. Repeat or severe violations may result in permanent suspension.

3. If a brand or individual reports impersonation, we may require official documentation to confirm identity before taking action.

Username Squatting Policy

Usernames are meant for personal or brand identity, not for resale or abuse. We do not allow username squatting, which includes:

Reserving usernames with no intention of using them in an authentic way.

Holding usernames to sell, trade, or profit from them in the future.

Registering usernames of well-known brands, businesses, or public figures without permission, especially if done in bad faith.

Creating multiple accounts to claim various high-profile or desirable usernames.

What Happens If You Violate This Policy?

If we determine an account is engaging in username squatting:

1. We may remove, rename, or reclaim the username at our discretion.

2. Repeat or severe violations may result in account suspension.

3. If a brand or individual requests a username that matches their trademark or identity, we may require official verification before transferring the username.

Reporting

We value feedback from our community. Users are encouraged to report ambiguities in the policy or suggest changes through a dedicated feedback channel. Educational resources will be provided to help users understand compliant vs. non-compliant content, fostering a better-informed user base.

Data and Privacy

All data related to content moderation, including proof of consent for shared images, will be securely stored and accessed only when required for policy enforcement. Moderation processes will prioritize user privacy and transparency, with users being informed about how their data is used.
